Welcome to Sacred Essence. In these Terms of Service, "we", "us" and "our" mean Sacred Essence, an online store operated by Sebastian Lawson, an independent dōTERRA Wellness Advocate (ID 20547111), of Level 1/672 King Street, Newtown NSW 2043, Australia. Sacred Essence is not authored by, endorsed by or an agent of dōTERRA or any of its affiliated companies, and we bear sole responsibility for the content of this website.

These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, describe your rights and responsibilities when you use this store. By visiting or buying from this store you agree to be bound by them.

1. Access and account

By agreeing to these Terms you confirm that you are at least 18 years of age, or the age of majority in your state or territory. To place an order you may be asked for your email address and your billing, payment and delivery details. You confirm that the information you give us is correct, current and complete. You are responsible for keeping your account credentials secure and for all activity on your account.

2. Our products

We sell genuine dōTERRA products in their original, sealed packaging. We do not repackage, decant or split products. We have made every effort to represent our products accurately, but colours and appearance may differ from how they look on your screen.

Product descriptions on this site are general information about scent and everyday use. They are not medical advice, and nothing on this site is intended to diagnose, treat, cure or prevent any disease. Always read the label and follow the directions for use. If you are pregnant, nursing or under a doctor's care, consult your health practitioner before use.

3. Orders

When you place an order you are making an offer to buy. We may accept or decline any order at our discretion. Your order is accepted only when we confirm it, and we must receive your payment before an order is accepted. If we decline, change or cancel an order we will contact you using the email address you gave us.

Returns and exchanges are dealt with under our Refund Policy. You confirm that your purchases are for your own personal or household use, and not for commercial resale or export.

4. Prices and payment

All prices are in Australian dollars and include GST where applicable. Prices, discounts and promotions may change without notice. The price that applies to your order is the price shown at the time you place it, as set out in your order confirmation email. Posted prices do not include delivery charges, which are shown at checkout.

You confirm that the payment details you provide are true and complete, that you are authorised to use the payment method, and that you will pay all charges incurred at the posted prices, including delivery.

5. Delivery

Delivery is covered by our Shipping Policy. Delivery times are estimates provided by the carrier and are not guaranteed. Nothing in this clause limits your rights under the Australian Consumer Law.

6. Intellectual property

The text, images, graphics, layout and design of this website are owned by us or our licensors and are protected by Australian and international intellectual property laws. You may use this website for your personal, non-commercial use only. dōTERRA and all dōTERRA product names and logos are trademarks of dōTERRA Holdings, LLC and are used here only to describe the genuine products we sell. All other names, logos and trademarks belong to their respective owners.

7. Third-party links and tools

This website may link to websites operated by third parties. We do not control them and are not responsible for their content or practices. If you leave this website to use them you do so at your own risk.

8. Relationship with Shopify

Sacred Essence is powered by Shopify, which enables us to provide this store to you. Any sale or purchase you make is made directly with Sacred Essence. Shopify is not responsible for any aspect of a sale between you and us.

9. Privacy

All personal information we collect is handled in accordance with our Privacy Policy. Because this store is hosted by Shopify, Shopify also collects and processes information about your use of the site, and that information may be transmitted outside Australia.

10. Reviews and feedback

If you send us reviews, suggestions or other content, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify and publish it, including for commercial use. You confirm that the content is yours to give and does not infringe anyone's rights. We may edit or remove it.

11. Errors and omissions

Occasionally information on this site may contain errors relating to descriptions, pricing, delivery charges or availability. We may correct any error and update information at any time without prior notice, including after you have submitted an order. Where an order is affected by a pricing error we will contact you before dispatch and you may cancel for a full refund.

12. Acceptable use

You may use this website for lawful purposes only. You must not use it to break any law, infringe anyone's rights, harass any person, transmit false or misleading information, send spam, impersonate another person, upload malicious code, scrape data by automated means, or interfere with the security of the site. We may suspend or terminate your access if you breach these Terms.

13. Termination

We may end this agreement or your access to this website at any time. You remain liable for any amounts owed up to the date of termination. Clauses that by their nature should survive termination will continue to apply.

14. Consumer guarantees, warranties and liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.

Subject to the paragraph above, and to the fullest extent permitted by law, this website and the products offered through it are provided on an "as is" basis, and we are not liable for any indirect or consequential loss arising from your use of this website. Where our liability cannot be excluded but can be limited, it is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price paid.

15. Indemnity

You agree to indemnify us against any loss, damage or claim, including reasonable legal costs, arising from your breach of these Terms, your breach of any law, or your use of this website. This does not apply to the extent the loss was caused by our own breach or negligence.

16. General

If any provision of these Terms is found to be unenforceable, it is severed and the remaining provisions continue to apply. Our failure to enforce any right is not a waiver of it. These Terms, with the policies referred to in them, are the entire agreement between you and us.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and Sacred Essence submit to the non-exclusive jurisdiction of the courts of New South Wales.

18. Changes to these Terms

You can review the current version of these Terms on this page at any time. We may update or replace any part of them by posting the change on this website. Your continued use of the site after a change takes effect means you accept it.
